Something’s rotten in the state of ‘Glendale’

For the bullet summary, please go here.

But nothing is stopping the NHL from bidding $220 million except its constitution, BOG, and business ethics – nothing it can’t get around.
Joe Smith

“Something is rotten in the state of Denmark“. ..as said by the minor character, ‘Marcellus’ in Shakespeare’s play ‘Hamlet’ in act I, scene IV.

What did Marcellus mean by the ‘state’ addition to his comment? Well, according to scholars, the fact that Marcellus mentioned the ‘state’ is to suggest the ‘rotting fish’ of the political situation is from the top down. The reason the state is in terrible, corrupt condition is directly a reflection of the head of the state.

Is something rotten in the state of the NHL?

Gary Bettman: Doth he protest 'too much'?

Gary Bettman: Doth he protest 'too much'?

At this stage, many would argue yes. It brings back the other quote of interest, “”The lady doth protest too much, methinks”", in Hamlet, Act III, Scene 2.

The queen said this to suggest that when someone complains ‘too much’ it suggests they have something to hide. What is so important to protect in Glendale? What is so important and potentially damaging that cannot be uncovered in the ‘state of the NHL’?

Can we conclude the NHL and in particular, the Commissioner protests ‘too much’?

It brings us back to a previous article or two. One, where I question why Gary Bettman is putting his identitiy in this, and protesting too much. Another, that suggests there is a tremendous amount at stake in land and taxes to want to ensure the bricks stay in place. A political reasoning could be at the heart.  But why would the commissioner of hockey be involved in the political infrastructure of America? Would it explain the systematic placing of hockey teams in locations where municipal infrastructure growth was desired?

Just take a look at an aerial photo of Arizona and see how much sand there is to turn to cement. Lots of potential, and we know now that Glendale is not the only city going for broke in the strategy to have the rich, private equity develop their cities.

When Ron McLean, in a now famous interview with Gary Bettman asked if there were indeed folks in Glendale that wanted to have a hockey team there, Bettman said he believed there was.

Now, after Jerry Reinsdorf has pulled out amongst a myriad of uncovering of the truth, we have Bettman scrambling to Plan C. Plan B of course is the addition of the backup bidders, Ice Edge.

Ice Edge, had a bid of similar proportions to Reinsdorf, but bid $2 million more. Reinsdorf was on record as saying they would not get in a bidding war. Ice Edge a convenient backup plan if the truth be known in Glendale? Likely yes, and how convenient.

Research Edge (Ice Edge) has been shown to be a close relation to the friends of Glendale by the article mentioned above, and really brings us back to the question of who Gary Bettman said he would tell. To McLean: “I will tell them before I tell you”. The question again, is ‘Who is them?‘.

When Jim Balsillie was rejected by the NHL Board of Governors, we asked the question whether the inmates should be allowed to police themselves, to the detriment of some other inmates. Dirty Harry (Balsillie) needs to come in to handle the corruption brewing in the NHL. Will the court system be able to see there is something rotten too, and will the government powers that be be able to send in the troops to audit the affairs of the NHL?

Believe me, there is enough ‘protesting’ to raise those red flags quickly in a flag store running out of stock. Time for the government to police the unpoliceable, before Gary Bettman takes his puck from the sandbox, and goes home.

How much control does a league and it’s chief think they can have? How much bending of the rules and constitution can one man and league bend?

There is surely something rotten with the state of the NHL, and we must understand that without external influence and reigning in at this point will spell disaster.

The United States Bankruptcy system and U.S. Court system is being played the fool.

When a man can take his puck from the sandbox, turn around go home, and sell it to who he wants, what does that say of the power of a sports league, despite legal processes?

Is the commissioner protecting the league by wanting to buy the team in Glendale? Or is the commissioner, at all cost, trying to avoid certain people from opening a door of transparency?

When Jerry Moyes at the beginning of this process said that he would allow the court to bring transparency, I don’t even think Jerry Moyes knew the magnitude of his statement.

The U.S. Department of Fiscal Policy and the U.S. Justice department happened by to this site one day.

I would suggest they ‘happen by’ the offices of the National Hockey league, magnifying glass in hand.

There is much more to be told, and we are just getting restarted. Where are the concessions needed by Glendale? But let’s start at the beginning.

There is something rotten in the states of Glendale, and the NHL.

The Passion that Unites us All!

With all your 'passion' Canadians, you'll get over it!

With all your 'passion' Canadians, you'll get over it!

For the bullet summary, please go here.

Just in case things don’t go the ‘Canadian’ Way in the Glendale Court…..

Fellow hockey fans of Southern Ontario, Canada, and the World:

Perhaps we are just not that important.

We can come to that conclusion based on the attitude of the National Hockey League, the Toronto Maple Leafs, the NHL’s Board of Governors, the reporting from major newspapers in the GTA, and others.

We are just not that big a deal.

Who are we kidding? After all, we are hockey nuts, right? Or, are we just nuts that like hockey?

We are powerful and have a strong voice that will really impact the NHL and they had better treat us right. Or, are we just a minor inconvenience that will blow over, and the true hockey fans located for the mostpart in the U.S. don’t know or for that matter, even care that we are upset. Is that it?

It must be OK for the NHL head office and the teams voting against Jim Balsillie to give it to Jim and to us. We’ll get over it. We are true fans, and we really can’t stay away from the game. We will get over it, and flock around our television sets once again when the puck drops next season. We will watch as the cameras scan over the crowds in the sunbelt U.S., strategically placed to ensure it looks like the stands are full.

We will watch, and we will wonder what it would be like to walk up to a ticket booth on game day, and buy some really good seats to see a couple of teams, and a game that looks much faster in person. Those lucky fans, we will think, as we blog, and gossip with other Canadians in Southern Ontario, that gather in front of the TV to watch the Canadian game, in the only way we can. Artificially that is.

We will continue to wonder if the circumstances that surrounded Winnipeg and Quebec City were truly as bad as we would be led to believe. We will wonder how they feel when they, on a Saturday night, gather with their memories and passion, around their collective TV sets to see the game in the only way they now can. Virtually.

We will wonder how they feel as they watch their old teams. Do they still have the passion for their team? The players are mostly if not all gone. Do they still think of the team as ‘their team’? We will wonder because that’s all we can do.

From coast to coast, the Leafs remind us of a passion that unites us all. The Toronto Maple Leafs would hope it was their team that unites us. The question is, does it?

The NHL must know something we don’t. The Toronto Maple Leafs too don’t seem too concerned. They must think this urge and desire to see real NHL hockey in person is a dream we can get over.

We will put our differences aside, and our resentment to the Toronto Maple Leafs organization for the obvious attitude of superiority, and we will learn again to love those Leafs, despite how dismal a display they will have on the ice again this year, like all the other years.

We’ll get over it because we are hockey fans, and they are banking on us not being able to resist the game.

They know we are saps that will continue to take whatever they dish out, and come back. And, if we are lucky, really lucky, perhaps we will win the lottery, and someone will offer to sell us a couple of seats to a Leaf game this year.

We will get over our hope to have hockey for the masses. Where a family can go online and buy a few seats to an upcoming Hamilton game, and treat the family to true, professional hockey. We will survive. Our kids will survive. It’s just the way it must be.

And, we will get over the memory of knowing that the Phoenix Coyotes hockey team to the City of Glendale, AZ was more to do about land and area development, and that ‘that hockey team’ was simply a means to achieve city growth. We will learn to put our differences aside. We will learn to forgive the snow job fed the people of Arizona when the team is relocated. After all, all the hype of the court case by that time will have blown over, and reality will be easier to palate.

We will learn to forgive the notable hockey players in the NHLPA that didn’t squeek a rah rah when we were in time of need. We will learn to forgive the Canadian hockey players that have a better tax deal playing and living in the U.S., because despite the fact they are Canadian, we must forgive the fact they need to bank the millions now, while they are still healthy. We will learn that to be a Canadian playing the NHL game means sacrificing your heritage and patriotic pride.

It is much more important to have NHL hockey in the deep southern United States, where to sell a seat, you must throw in a program, perhaps a burger, and maybe that beer.

It is much more important to see if Gary Bettman and the NHL can get a lucrative TV deal despite the fact that college wrestling stands a better chance.

It is much more important to ensure NHL hockey gets exposed in a geographic manner so that more merchandise can be sold as a novelty to people that don’t really like the game necessarily, but think the clothing looks cool. And, let’s not forget Gary. Gary gets a piece of the profits of that merchandise. That is so important. What were we thinking?

Yes, we Canadians are expected to get over it.

We will not sign petitions, or stop buying merchandise, or revolt against the machine.

Yes, the Toronto Maple Leafs have a slogan, the Passion that Unites Us All!

I guess they will ensure the passion to see hockey will remain a passion to see ‘Leaf’ hockey, come hell or high water.

There may be a new passion building in Southern Ontario, in Winnipeg, in Quebec City, and other parts of Canada.

Will we get over it? They certainly hope so.

The new breed of ‘passion’ of the Canadian hockey fans may tell a different story in the coming days, weeks, months, and years.

There may be a new and improved passion that unites us all. Let’s see what that is!

Thanks for that 'blogging' info Dave

You don't blogging well say, Dave?

You don't blogging well say, Dave?

Well…

I ran into a Sunday Toronto Star report (opinion) from Dave Olive.

Thanks for the info Dave.

Good to know the 200 or so folks that might want to read this or any blog are inconsequential to ‘change the world’.

Good also to know that the average blog only survives about three months, because the bloggers want to make money, and well, I guess can’t with such a meager readership.

Hitching a ride on major newspapers is the only way to sell out you say?

Maybe you are right. I see a little bit of jealousy in your writing Dave? Do I?

Is this the ‘I can’t say what I want cause I need to toe the MSM line, and the way I get back at you smarty-pants bloggers is tell you that unless you become attached to a paper you won’t have any impact’?

Would it be better to impact 200 in a big way, or 2 million in a whitewashed, inconsequential way?

Mainstream media does have it’s readership from the past, but once bloggers figure out a way to market themselves in a bigger way, perhaps MSM should be the ones to worry.

It would seem people are thirsting and hungering for more meat and truth.

Is the mainstream media so afraid of lawsuits that they have watered down true reporting? Killing trees for what, exactly?

What do you say Dave? Cat got your tongue?

Mixed signals in this dragging on saga: Enough already!

For the bullet summary, please go here.

Derek King is becoming the assistant coach of the Toronto Marlies.

King may be moving from Scottsdale, Arizona, where he had lived and worked as a real estate agent, and worked in the development camp for the Phoenix Coyotes.

King was born in Hamilton, Ontario in 1967.

Is Derek King’s moving a signal that there is less opportunity with the Phoenix Coyotes, and is it also a sign that real estate growth in the Phoenix area is waining?

Does this give a hope for hockey in Hamilton, as King would be a reflection of ‘the sinking Coyote ship’?

On the other hand, we have the Ontario Teachers’ Pension Fund buying up the shares owned by CTV Globemedia and increasing their share of MLSE to a tune of 66%. That’s two-thirds ownership. Obviously they consider the profitability of MLSE to continue to grow. With ticket prices so outrageously high for Leaf games, I guess they have a point. I suppose the Ontario Teachers’ Pension Fund doesn’t think Hamilton will get a team, which would have a downward pressure on usury Leaf ticket prices anytime soon.

And, we have Jim Balsillie saying enough is enough already, and showing a level of confidence that his position in bidding is strong enough to force the court to stop the stall tactics of the NHL head office. A court imposed relocation fee and decision that he is an eligible owner is fast becoming expected from his legal team, and his deadline is now September 14th.

For all of us waiting and getting tired of how long this has dragged on, we applaud the ‘put up or shut up’ attitude of Balsillie.

So, we have King jumping ship for Toronto, the Teachers buying a bigger stake in MLSE, and Jim Balsillie putting more pressure on the powers that be to put an end to this already, in a move of confidence that his bid is solid.

Who are we to believe?

Real hockey fans in Canada and the U.S.A. will attest that this farce is getting old. The NHL’s dragging of it’s heals is going to hurt the game of hockey and it’s popularity.

Does the NHL think they can continue to insult the hockey fans of Southern Ontario and not have a revolt?

We’ll see.

Making it Work: Do 'they' know something we don't?

For the bullet summary, please go here.

The lawyer for Jerry Reinsdorf had informed the court that they wouldn’t be in court for much longer, wasting more time and money.

This really should make us wonder why they are bothering in the first place.

From day one, the City of Glendale has denied any claims of allowing for or negotiating concessions.

Jerry Reinsdorf’s bid, where it was accidentally leaked that there were quite a  number of significant expectations of concessions was met with disdain from the Reinsdorf camp that the information became known.

The Reinsdorf camp simply didn’t want  us to know.

So, what about wasting that time and money? Jerry Reinsdorf doesn’t like wasting either, and doesn’t do something for nothing.

If the Reinsdorf group didn’t think they could get away with ‘getting’ concessions from Glendale, then why are they wasting everybody’s time and money? That is, unless they know something we don’t.

For that matter, we still have the Daryl Jones Group in the battle, and the last time we heard from them, they are arranging the financing, and were in discussions with the City of Glendale too. Again, if there is no chance to do anything but raise ticket prices, why do they continue on their merry way, with expectations at the end of the day, that they will get something from Glendale.

Is this presumptuousness valid? The facts say it is crazy. Unless we don’t know the true facts.

Yesterday I laid out some potential people of influence that may affect the hockey bankruptcy. There is enough power and influence represented in that article to send a fighter jet to Somalia. Well, maybe as Canadians we can ask a favor of our own. Perhaps you could go look for and rescue Amanda Lindhout (from Alberta) and Nigel Brennan (from Australia). The families of these reporters are not sure their governments are doing anything to help at all. Come on Canada, you could give them an update, couldn’t you? Prime Minister Harper, we are not hearing from you on hockey, but for the love of God, please do something for Amanda and her family.

Well anyway, back to the relatively unimportant hockey case.

We are talking about presumtuousness in the Phoenix Coyotes case now.

Let’s examine some information I have uncovered, starting with Alan Leventhal.

Alan Leventhal is a trustee of Boston University. I was erroneous to suggest he was the Chairman of the Board of trustees still, as he has given that position up. He has been recently honoured for his years of service, and bringing transparency to the University’s operations.

What is interesting about Alan Leventhal’s involvement at Boston University is his level of ethics and integrity. In 2003, when Daniel Goldin was being brought in as President, Leventhal had a problem with the ethics of Goldin.

Apparently quickly upon taking office, Goldin pulled out what is described as a ‘hit list’, and effectively began firing some noteworthy people from the University. Also, the University suffered a bad reputation of trustees taking advantage of their titles at Boston U, and gaining from their relationships in their outside business interests.

Leventhal was a critic of Goldin for the ‘conflicts of interest’ that were tainting the University.

So, when Leventhal became the Chairman of the Board of Trustees the University made some changes:

BU trustees unanimously approved an overhaul of the school’s management in April 2004 after a failed presidential search exposed serious problems with the way the board operated. One of the most important provisions was designed to prevent trustees or their companies from doing business with the university, because one major criticism was that board members had financial ties to the school that created at least the appearance of a conflict of interest.

That was good, right?

We must understand that being in a position of power and influence in a University of high calibre can really affect potential personal gain, and the influence of a high position in a University breeds the potential for corruption.

Why did Daniel Goldin come in with high expectation and arrogance? Well, when you worked for the Presidents of the U.S. in the past, and were:

….former administrator of NASA under Presidents George H.W. Bush, Bill Clinton, and George W. Bush…..

you might start to feel a level of entitlement. And, apparently, Goldin took advantage of just that, and called in some friends to ensure he profitted by past and current relationships. The University was embarrased, and rightly so.

So, this make it even more surprising when in December 2004, the University lowered their standard, the standard just implemented eight months prior in April 2004:

But the actual policy approved and implemented by the board set a much lower bar, stipulating that a business relationship would not be allowed unless it ”has been found to be of clear benefit to the university.”

The University said the wording was ‘unworkable‘, and cited this:

”The feeling was that the ‘exceptional necessity’ language, if strictly applied, would have worked to the detriment of Boston University because it would have meant that we would not be able to do business with a best-in-class organization that provides substantial benefit and value to BU,” said Burgay, who used Lehman Brothers to illustrate his point. ”We needed a policy that protected the university from conflicts of interest and reserved the university’s ability to enter into business relationships that were in fact beneficial to us.”

Again, the question that comes to mind, that likely came to the mind of several of the professors at Boston U at the time is, ‘why all of a sudden make a ruling change?’ It really begs the question, ‘what relationship does someone see that would benefit them, but not fit into the guildelines?’ Doesn’t it? Or, is it just me?

I don’t think it is just me. You don’t make ruling changes for nothing, or under NO circumstances to justify them. So, what changed?

I do not have the answers, just many questions on relationships I have seen in a bigger picture surrounding the Phoenix Coyotes (go figure!).

Tying this in to the hockey case, you may recall in a previous article on Leventhal, that I said since Dr. Donald Fraser was a professor at Boston U, there was a good chance Alan Leventhal would have known him. Fraser, working as capacity of Board of Directors member of DRS Technologies, would know Eric Rosen.

Rosen, as ‘hands on’ director of DRS and partner in MSD Capital, could suggest Alan Leventhal would know Michael Dell. Well, without even knowing that, we know he knows Michael Reinsdorf, since Reinsdorf brought him in to assess the Jobing.com arena for the City of Glendale.

Alan Leventhal was reporting through Beacon Sports Capital to John Kaites and the City of Glendale for six months prior to Jerry Moyes declaring the team bankrupt.

This begs the question, where is the transparency of the group to Jerry Moyes? Didn’t Moyes deserve to know? Perhaps not Leventhal’s department? Perhaps. Technically, I guess not. Let’s give Leventhal  the benefit of the doubt.

Back to Fraser.

Dr. Fraser has some pretty impressive credentials, having specialized in Photonics.

When we need to know if there is a chance he knows Leventhal, it is fairly apparent, but it doesn’t hurt to add more to solidify this thought. In an article about scientific advances, Fraser had this to add in 2002:

”What we’ve formed here is a very unique thing for a university,” Fraser says. ”We can join research with funding and equipment and space and business expertise in one place.”

But Fraser acknowledges that, in the current environment, it’s difficult to raise money for Beacon Photonics, the center’s venture capital fund, and he says that his incubator space is currently less than half full. While the Photonics Center is already eight years old, it is still trying to prove that its model can work.

With Alan Leventhal’s dad a long time supporter of Boston University, it is very possible ‘Beacon’ Photonics lab was a family gift to the University. And it is likely a coincidence that the fund to raise money is named ‘Beacon’ as well. Suffice it to suggest that Alan Leventhal is familiar with the work of Dr. Fraser, and Dr. Fraser knows Alan Leventhal.

OK, so having substantiated the Leventhal family name with inroads in research, and the liklihood of Leventhal knowing Fraser, could this then help us tie Leventhal to the group in Glendale, AZ, the City and Ed Beasley?

Well, we know Leventhal knows Beasley and Reinsdorf. And, by the muckety map we previously examined, it is not a far stretch to path Leventhal to a ‘potential’ opportunity with MSD Capital.

Why the conflict of interest stringencies were reduced at Boston U, and the tie Dr. Fraser has with DRS Technologies does impose some questions.

Also, Leventhal acting as Chairman of the Board of Trustees does open up the possibility of personal gain from this position, further bringing into question why the ‘unworkeable’ terms of the conflict of interest guildelines were changed.

If Dr. Fraser had an opportunity to benefit from his tenure at Boston U with DRS, and DRS benefitting with relationship with the University, would this have been enhanced by the lowering of standards at the University? Just a question based on the facts, not an allegation. Just a question.

Dr. Fraser worked for Command Control from 1990 to 1991, for emulation technology. From 1991 to 1993 worked under the secretary of defence, at the U.S. Department of Defense (Remember the ties to the military concerns of the U.S. . We will return on this thought later when discusing the Cohen Group’s influence).

You see, when we have friends of friends, and everyone is helping out the other, we must look at the big picture and all the presentable facts to see if these potential relationships add to the big picture, with consistency of argument. That’s all, and it’s that simple.

So, DRS Technologies is a hub of potential relationships and a definite place where the powerful could be connected in the Phoenix Coyotes case. Let’s look at the muckety map on DRS again.

  • Mark S. Newman is the president and CEO.
  • Eric Rosen is a director and first cousin on Mark Newman
  • Donald Fraser is a Board of Directors member
  • The Cohen Group is a lobby Firm (William Cohen, fmr. Secretary of Defense)

So, moving on, we can again recall Eric Rosen who in the past worked in the New York office of Onex Corp, along with Daryl Jones (Research Edge). Rosen is the partner in MSD Capital with Michael Dell.

Donald Fraser, as discussed at length, was a professor at Boston U, and we have established unquestionable ties to Alan Leventhal (Beacon Capital). This has brought Leventhal into possible relationship through Fraser to Michael Dell and Eric Rosen at MSD Capital.

The Cohen Group head is William Cohen. At this point, it would be good to have a close look at the muckety map of William S. Cohen and we will throw Senator John McCain in there too.

So, we have William Cohen whose lobby group the Cohen Group represents DRS Technologies. Cohen was the best man at Sen. John McCain’s wedding.

Jerry Reinsdorf did political fundraising for John McCain in the 2008 presidential election.

We have influence in military spending (DRS Technologies and Cohen Group), health care spending (Onex Corp, and past relationships of Eric Rosen and Daryl Jones), and a whole lot of political pull that is present with Sen. John McCain.

Can we ask why we have not seen a lot of support from Sen. McCain to the Goldwater Group’s effort to stop land tax subsidies in Arizona? We can ask, but are we seeing a picture to suggest why?

Let’s remember that Jerry Reinsdord does not waste time and money too easily. His bid, and that of the Jones’ group is all about deals with the City of Glendale. Deals that Jerry Moyes could not get.

Michael Reinsdorf and Michael Dell established relationships of some magnitude with the City of Glendale over a long while. Jerry Moyes’ move to put the team into bankruptcy threw a monkey wrench into the relationships that were being nurtured with the City of Glendale, and no doubt angered Glendale.

Since then, the City has been in damage control, editing emails sent to Goldwater, and denying any concessions will be given. That’s what we hear. Why is reality different?

This case would have been over a long time ago had concessions been off the table.

Does Jerry Reinsdorf and Daryl Jones know something the rest of us don’t?

Lots of power and influence. Perhaps it’s time to ask a friend of a friend of a friend for a favor?

What do you think?

Notes on a meddly of power and influence: Relationships of chance or design?

For the bullet summary, please go here.

I am using this article to do some reasearch on people of influence who may or may not be tied together in the meddly of relationships surrounding the Phoenix Coyotes bankruptcy case.

To start, how influential would you have to be to visit the White House at Christmas, as did Daryl Jones of (Onex)? Well, Onex is a very large company indeed and has ties to the U.S. Health Care System for one. It makes you wonder about the parting of the ways of Daryl Jones and Eric Rosen, to other firms.

William S. Cohen was the best man at John McCain’s wedding, and Cohen was the former Secretary of Defense. His Cohen Group is the lobby firm working for DRS Technologies, which Eric Rosen is  a Director. Let’s remember, Eric Rosen left Onex, to become a partner with Michael Dell at MSD Capital.

DRS Technologies  is a major supplier to the U.S. government department of defense, granted several contracts.

This article will continue to grow over time as more information is obtained, and if you are inclined to do some research, please ensure you send it along by the comments section.

The bottom line is that the relationships that tend to grow in the U.S., makes the parties to the Phoenix Coyotes bankruptcy case a little more obvious.

For instance, are we to believe that Daryl Jones and his link to Onex and Eric Rosen was not an influence of his group’s sudden appearance as the good old boys from Canada and the U.S. looking to buy the Coyotes? Or, would it make sense that there is much more in the way of past and future relationships that would benefit Research Edge outside of the hockey team? I think we know that answer.

And, we must ask ourselves a very important question that even strong relationships cannot penetrate. What about the concession demands by both the Jones group and the Reinsdorf group on the City of Glendale?

How is Glendale supposed to grant any concessions, as reported earlier,  because there are no concessions that will be allowed, and Glendale repeatedly denied any concessions will be granted? It truly is the hinge here, because without concessions of any kind, it is obvious this hockey team will not fly financially. Here is an excerpt:

Freeman said if the Arizona Supreme Court rules against the CityNorth subsidy from Phoenix and puts greater restrictions on such incentives, that could hamstring economic concessions Glendale might be able to offer the Coyotes. The NHL team has lost more than $300 million since moving to the Phoenix market in 1996 from Winnipeg.

There is one thing that is perfectly clear. The relationships in the following notes show there may be a bigger cause and bigger picture here. Could this case be a reflection of wanting to ensure some ‘deals’ of infrastructure growth of America do not wain? Because, if one brick falls off the building, the chances are more are to follow. For that reason, it is important to ensure the first brick is cemented back into place.

Although it is hard to imagine the Phoenix Coyotes as representative of a brick in the infrastructure and networking of America’s top powers and influence, I think we might actually be surprised to find it may be closer to the truth than we think.

The days of large real estate profits to the dotcoms of the year 2000 are over. Since then, real estate vacancies are up huge. No matter how much wealth you may have, the tanking of the economy can leave a cash flow crisis of epidemic proportions. This has left the poor and the wealthy alike scrambling to redefine and hedge their investment bets. What we may be witnessing as a bi-product of hockey woes, is a larger problem faced by America.

Have a look and do some thinking and research on your own. See what you can come up with related to how this ‘muck’ is forming. And return over time, as we add more cement to this network.

When the 'inmates' run the 'Pen': One flew 'out of' the Cuckoo's nest!

For the bullet summary, please go here.

The inherent nature of sports leagues will eventually breed corruption, and the NHL is a ‘corruption poster child’!

Help, police, help!!

Help, bankruptcy court, help!!

Help, U.S. Department of Justice, help!!

Is anyone going to help?

Anyone?

The "Make My Day Law" should be extended to Business interests and justice....."Go ahead punk, make my day"

The "Make My Day Law" should be extended to Business interests and justice....."Go ahead punk, make my day"

If you have been around long enough, you can recall who you were friends with, and whose house you gathered in to watch Dirty Harry movies. Or, all Clint Eastwood movies for that matter. The crook had a choice, give up and go to prison, or if he felt lucky, to ‘Go ahead, and make Harry’s Day’.

Harry was a movie hero. Vigilante justice was his specialty. Filling in a void where law seemed to have too many loopholes and cracks, and allowed the guilty to get away with all kinds of ‘bad stuff’.

Harry represented the cop on the edge, the one ready to do what it took to ensure the scum did not get away with it!

Harry sent many bad guys to jail! Well, if the prisons were run by the inmates, you would think Harry would have convinced more of those guys to ‘make his day’. If Harry knew the system was corrupt, he might have  become a vigilante to change the system.

What if the prisons were run by the inmates?

On the ‘inside’, there are ‘rules’ that you must follow, and people you must respect. If you don’t, heaven help you. A shiv may be at your throat or side, and you may be in deep trouble.

Well, what if there was more going on in the Pen than just secret little games, and a sub culture? What if the inmates took control over the institution itself? What if the powers that be decided to surround themselves with other inmates, and it bred more corruption?

Well, we might not be talking about penetentiaries here, but in a sense we are talking about protecting the rights of the less corrupt  inmate(s). What if there is an inmate in trouble? What if the bullies in the Pen are bothering him, and want him ‘taken care of“? If the inmates run the show, who is there to police the inmates?

The NHL as any sports league is ‘self-policing’, as described in this article by Slam Sports:

“The sports leagues are sort of a self-selected, closed group,” Eric Schaffer, a senior bankruptcy partner at the Pittsburgh law firm Reed Smith, said this week in an interview. “They decide who is going to be admitted to their league, they police themselves.

They also want to make sure they retain the ability to be the exclusive arbiters of who is going to be in their membership.”

Sure they want to ensure they pick and choose who enters the club. The same kind attracts like kind. A less than ethical person tends to find other, less than ethical people. It’s really that simple.

The Phoenix Coyotes case has been in large part about a man who ‘flew the cookoo’s nest’. Jerry Moyes was being bullied in the NHL club. He decided he had enough, but could not turn to the very league that was conspiring to put him away financially. No, he needed a Harry Callahan.

Did Jerry Moyes find the man who would help him change the system? The man that would stand up to the corruption, the greed, the unfair business practices, and the good boys club, and say enough is enough? I think he did.

Filling the void where law cannot always help

Filling the void where law cannot always help

We can look at Jim Balsillie as Harry. A man often criticized, and often portrayed as the bad guy, when indeed he is the only one that will stand up to the corruption of his day.

And, is standing up to the current system a bad thing?

Not according to a scholar:

Ross, a sports law and antitrust scholar, said a victory by Balsillie would be a good thing because the major professional sports leagues have too much power over ownership.

Sports leagues have illegal monopolies by preventing new entry from deserving clubs,” he said in an email to The Canadian Press. “Sports leagues harm consumers by being run by the clubs themselves, in their own self-interest, instead of the best interests of the league as whole.”

If Dirty Harry got arrested in the movies as a corrupt cop that doesn’t play by the rules, people would look, turn away, and ignore him. And when Harry did his thing, and saved the ‘streets’ from more bad guys it would largely not be discussed. A silent hero.

Well, it’s time Harry and all the Harrys’ out there get the thanks they deserve.

I, and many other Canadians are standing behind our Harry! There will be much fallout from this case, and we will likely not stop until things change. Whether vigilante style or otherwise, the NHL is broken. The inmates are running the Pen, and it is high time that got changed.

Jerry Moyes was a victim and a reflection of the abuse and control a league gone bad can have. He was chewed up and spit out by a vicious plan to strip him of his wealth, then his title, and sense of manhood.

Well, Jerry Moyes has turned out to be the white knight of Canadian hockey. He and Jim Balsillie are dishing out there own version of vigilante justice that will continue to fill the void, where law fails.

We can only hope that the justice system will learn from this case and make the necessary changes to change the rules. All to ensure the inmates don’t run the institution. Especially when it affects the safety and rights of fellow inmates.

The ‘Make My Day Law’ has been a law instigated to protect people from violence. Should there be a version created for business bullying and corruption to protect the rights of franchise owners?

Go ahead, make our day!

Go ahead, make our day!

NHL, we all know this has been a case of corruption, greed, collusion, and bullying. We also know that Jim Balsillie represents the exposure of this, and the attempt to stop it. So, we here in Canada stand behind Jim. So, NHL, ‘Go ahead, make our day!’
